1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Balkan AI, the mobile application operated by MODEX Apps ("we," "us," or "our"). By downloading, installing, or using Balkan AI, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use Balkan AI.

These Terms apply to all users of the app, including users in Albania and internationally.

2. The App and Our Services

Balkan AI is a premium mobile application that provides:

• Cultural guides, tourism itineraries, and travel information for Balkan countries
• Curated meme feeds and interactive meme battle features
• AI-powered cultural and historical explainer tools
• A daily content ritual ("Dnevni Bolan")
• Country alert and safety information feeds
• Weekly cultural challenges

Features may be updated, added, or removed at any time. We reserve the right to modify the app's functionality without prior notice, though we will not remove core features that were present at the time of your download without reasonable notice.

3. Free App & Optional Purchases

Balkan AI is free to download and use through the Apple App Store and Google Play Store. All features are available at no cost.

3.1 Optional Tip Jar

The app offers an optional in-app tip/support purchase. These are voluntary consumable purchases processed by Apple or Google. MODEX Apps does not handle, store, or process your payment information directly.

3.2 Refund Policy

Refund requests for optional purchases may be submitted through the Apple App Store or Google Play Store in accordance with their respective refund policies.

4. User Conduct

You agree to use Balkan AI only for lawful purposes. You must not:

• Use the app to engage in or promote harassment, hate speech, or discrimination based on ethnicity, nationality, religion, gender, or any protected characteristic
• Use AI features to generate content that defames, threatens, or harasses individuals or groups
• Attempt to reverse engineer, decompile, or extract source code from the app
• Use automated tools, bots, or scripts to access app content
• Attempt to circumvent, disable, or interfere with security features of the app
• Use the app in any manner that violates applicable laws or regulations
• Impersonate MODEX Apps, our staff, or any other person or entity

We reserve the right to terminate access to the app (where technically feasible) for users who violate these conduct requirements.

5. AI-Generated Content

Balkan AI includes AI-powered features including "Balkan-ify This," "Roast the Map," "Explain to Grandma," meme generation, and the Power AI Mode. Regarding AI-generated content:

• AI content is generated for entertainment and informational purposes only.
• AI-generated content may be inaccurate, incomplete, or culturally inappropriate. Always apply your own judgment.
• For historical and geopolitical claims, the app displays source citations. However, cited sources should be independently verified for critical decisions.
• You are solely responsible for how you use or share AI-generated content from the app.
• MODEX Apps does not endorse, verify, or take responsibility for user-prompted AI outputs.

6. Content and Meme Feed

Balkan AI aggregates content from publicly available sources, including Reddit subreddits, for the meme feed feature. Regarding this content:

• Content is curated and moderated but may not always meet the standards of every user.
• Meme content is for entertainment purposes and does not represent the views of MODEX Apps.
• If you encounter content that violates these terms or is offensive, report it to modexapps@gmail.com.
• Content creators retain rights to their original works. We do not claim ownership over third-party content displayed in the feed.

7. Intellectual Property

The Balkan AI application, including its design, interface, branding, original written content, and software, is owned by MODEX Apps and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use Balkan AI for your personal, non-commercial use.

You may not:

• Copy, reproduce, or redistribute the app or its content without permission
• Use MODEX Apps' or Balkan AI's branding without prior written consent
• Create derivative works based on the app

8. Disclaimers

Balkan AI is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Guarantees that the app will be error-free, uninterrupted, or secure
• Accuracy or reliability of AI-generated content, historical information, or travel advice

9. Limitation of Liability

To the fullest extent permitted by applicable law, MODEX Apps shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or goodwill
• Damages arising from your reliance on AI-generated content
• Damages arising from inaccurate travel or safety information
• Any damages arising from your use of the app

Some jurisdictions do not allow limitation of certain warranties or damages. In such cases, our liability is limited to the maximum extent permitted by law.

10. Privacy

Your use of Balkan AI is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the app, you consent to the data practices described in the Privacy Policy.

11. Availability and Termination

We reserve the right to modify, suspend, or discontinue the app or any feature at any time. If we permanently discontinue the app, we will provide reasonable notice.

We reserve the right to restrict your access to the app if you violate these Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Albania, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Balkan AI shall be subject to the jurisdiction of the courts of Albania.

If you are located in the European Union, nothing in these Terms affects your rights under applicable EU consumer protection law.

13. Changes to These Terms

We may revise these Terms at any time. When changes are material, we will notify users within the app. The updated Terms will be effective from the date posted on this page.

Your continued use of Balkan AI after the effective date of revised Terms constitutes your acceptance of the changes.
